Esta política explica cómo Kokaru, servicio de Nagare Japan Inc., accede, recopila, usa, comparte, retiene y elimina tus datos personales, incluidos tus datos de salud.

Todos estos permisos son opcionales y se piden en el momento en que usas la función. Puedes revocarlos en cualquier momento desde los ajustes de tu dispositivo; la app sigue funcionando con las funciones restantes.
Kokaru puede leer y escribir datos en Health Connect y en Apple Health solo si tú lo autorizas desde tu dispositivo, y únicamente para mostrarte tus métricas y tendencias de bienestar dentro de la app.
Pasos, calorías activas, pisos subidos, sueño, peso, grasa corporal y masa corporal magra.
Las mediciones de tu pulsera Kokaru: frecuencia cardíaca, variabilidad de la frecuencia cardíaca (HRV) y sesiones de sueño, para que puedas verlas junto al resto de tus datos de salud.
No tomamos decisiones automatizadas con efectos jurídicos sobre ti. Los puntajes de Kokaru son informativos y no constituyen un diagnóstico médico.
No vendemos ni cedemos tus datos. Solo los compartimos con estos encargados, con contrato de tratamiento de datos y confidencialidad:

También compartimos con los profesionales de la salud que tú elijas mediante los enlaces temporales que tú generas, y con autoridades cuando exista una obligación legal. Si alguna vez transferimos el servicio a otra empresa (fusión o adquisición), te lo avisaremos antes y la política seguirá aplicando.
Las búsquedas de alimentos y medicamentos se resuelven contra catálogos alojados en nuestra propia infraestructura: no se envían a terceros.
Si accedes a Kokaru a través de tu empleador, este contrata el servicio pero no accede a tus datos individuales. El portal de empresas muestra únicamente agregados anónimos, sujetos a k-anonimato: si un grupo es demasiado pequeño para impedir que se te identifique, no se muestra. Tu empleador no recibe tus métricas, tu ficha médica ni tus puntajes individuales, y estos datos no se usan para decisiones laborales de ningún tipo.
Quién decide. En Kokaru Kids y en Kokaru Senior el titular de la cuenta (madre, padre, tutor legal o familiar a cargo) decide qué familiares pueden ver la información y puede quitarles el acceso en cualquier momento. En Kokaru Kids hay como máximo dos titulares por niño o niña, y verificamos la tutela antes de habilitar la red abierta.
Ubicación. La ubicación se obtiene del gateway Kokaru que oyó la pulsera. Los lugares que tienen un gateway (colegios, centros u otras casas) no ven a ningún niño ni sus datos: solo transportan la información cifrada. Cualquier titular puede pausar la ubicación; para reanudarla, si hay dos titulares, deben estar de acuerdo ambos. Cada cambio queda en una bitácora que no se puede editar.
Gateways de hogar. Si instalas un gateway en tu casa, puedes elegir si comparte su ubicación con la red Kokaru Kids. Si lo compartes, las familias de los niños que pasen por tu casa ven solo el punto en el mapa, nunca tu nombre ni tus datos. Puedes desactivarlo cuando quieras.
Kokaru Senior en centros. Cuando un centro o residencia contrata Kokaru Senior, el centro actúa como responsable frente al residente y nosotros como encargado: su equipo ve el estado de los residentes que atiende y los familiares que el centro o el titular autorizan.
Tratamos tus datos de salud sobre la base de tu consentimiento explícito (art. 9.2.a GDPR y normativa equivalente), que puedes retirar en cualquier momento. El resto de los datos se trata para la ejecución del contrato (prestarte el servicio), el cumplimiento de obligaciones legales (tributarias y contables) y nuestro interés legítimo en la seguridad y la prevención del fraude. Retirar el consentimiento no afecta la licitud del tratamiento anterior.
Conservamos tus datos mientras tu cuenta esté activa. Al eliminar tu cuenta o solicitar el borrado, eliminamos tus datos en un plazo máximo de 30 días, con estas excepciones:

Según tu país, tienes derecho a acceder, rectificar, eliminar, limitar u oponerte al tratamiento, a la portabilidad y a retirar tu consentimiento. Escríbenos a privacidad@kokaru.com; respondemos dentro de 30 días. Aplicamos, según corresponda: Japón (Ley de Protección de Información Personal, APPI), Chile (Ley N° 19.628 y Ley N° 21.719) y Unión Europea / EEE (GDPR). Si no quedas conforme, puedes reclamar ante la autoridad de protección de datos de tu país.
Todo el tráfico entre la app y nuestros servidores viaja cifrado con TLS, y tus datos se almacenan cifrados en reposo. El acceso a la base de datos está restringido por políticas por usuario (row-level security), de modo que cada cuenta solo alcanza sus propios datos, y el acceso del personal está limitado a lo estrictamente necesario y sujeto a confidencialidad. Ningún sistema es infalible: si ocurriera una brecha que afecte tus datos, te lo notificaremos y avisaremos a la autoridad competente dentro de los plazos legales.
La app Kokaru (Wellness) no está dirigida a menores de 16 años. Kokaru Kids sí trata datos de niños y niñas, siempre bajo la responsabilidad y con el consentimiento de su madre, padre o tutor legal, que es quien crea la cuenta, decide quién ve la información y puede pedir su eliminación. Los datos de niños se usan solo para mostrar a sus titulares su sueño, actividad, ubicación por zona y momentos de bienestar; nunca para publicidad ni perfiles comerciales. Kokaru describe lo medido y no diagnostica. Si crees que tenemos datos de un menor sin autorización, escríbenos a privacidad@kokaru.com.
Operamos desde Japón y prestamos el servicio en Chile, Colombia, Japón y Europa. Algunos de nuestros encargados (Supabase, Stripe, Mercado Pago, Resend, Anthropic, OpenAI, Cloudflare, Railway) procesan datos en Estados Unidos y otros países. En esos casos aplicamos las garantías que exige la normativa —cláusulas contractuales tipo de la Comisión Europea u otro mecanismo válido— y limitamos contractualmente el uso de los datos a prestarnos el servicio.
kokaru.com no usa cookies de seguimiento, analítica ni publicidad, y no instala rastreadores de terceros. Solo usa una cookie funcional (kk_site) que recuerda el país que elegiste, para mostrarte precios y medios de pago de tu país. Las apps web usan solo el almacenamiento local necesario para mantener tu sesión iniciada.
Puedes ejercer tus derechos de acceso, rectificación, supresión, oposición, portabilidad y bloqueo en kokaru.com/proteccion-de-datos o escribiendo a privacidad@kokaru.com. Respondemos dentro de 30 días corridos, prorrogables una sola vez por 30 días más. Si no quedas conforme, puedes reclamar ante la autoridad de tu país: en Japón, la Comisión de Protección de Información Personal; en Chile, la Agencia de Protección de Datos Personales.
Podemos actualizarla. Cuando el cambio sea sustancial te avisaremos dentro de la app o por correo antes de que entre en vigor, y —si la ley lo exige— te pediremos de nuevo tu consentimiento. La fecha de vigencia siempre aparece al comienzo.

This policy explains how Kokaru, a service of Nagare Japan Inc., accesses, collects, uses, shares, retains and deletes your personal data, including your health data.
The controller is Nagare Japan Inc. (“Kokaru”, “we”), a Japanese company represented by Koji Suzuki, Ginza TH Building 9F, 7-13-20 Ginza, Chuo-ku, Tokyo 104-0061, Japan. We do not knowingly collect data from minors outside Kokaru Kids (section 15), nor any data category not listed above.

All these permissions are optional and requested when you use the feature. You can revoke them at any time in your device settings; the app keeps working with the remaining features.
Kokaru can read and write data in Health Connect and Apple Health only if you authorise it on your device, and only to show you your wellness metrics and trends in the app.
Steps, active calories, floors climbed, sleep, weight, body fat and lean body mass.
The measurements from your Kokaru band: heart rate, heart rate variability (HRV) and sleep sessions, so you can see them alongside your other health data.
We do not make automated decisions with legal effects on you. Kokaru scores are informational and are not a medical diagnosis.
We do not sell or assign your data. We share it only with these processors, under data processing and confidentiality agreements:

We also share with the health professionals you choose through the temporary links you generate, and with authorities where there is a legal obligation. If we ever transfer the service to another company (merger or acquisition), we will tell you beforehand and this policy will continue to apply.
Food and medication searches are resolved against catalogues hosted on our own infrastructure: they are not sent to third parties.
If you access Kokaru through your employer, they pay for the service but do not access your individual data. The employer portal only shows anonymous aggregates, subject to k-anonymity: if a group is too small to prevent you from being identified, it is not shown. Your employer does not receive your metrics, medical record or individual scores, and this data is not used for employment decisions of any kind.
Who decides. In Kokaru Kids and Kokaru Senior the account holder (mother, father, legal guardian or responsible family member) decides which family members can see the information and can remove their access at any time. Kokaru Kids allows at most two account holders per child, and we verify guardianship before enabling the open network.
Location. Location comes from the Kokaru gateway that heard the band. Places that host a gateway (schools, centres or other homes) do not see any child or their data: they only relay the encrypted information. Any account holder can pause location; if there are two holders, both must agree to resume it. Every change is recorded in a log that cannot be edited.
Home gateways. If you install a gateway at home, you choose whether it shares its location with the Kokaru Kids network. If you share it, the families of children who pass by your home see only the point on the map, never your name or your data. You can turn it off at any time.
Kokaru Senior in care centres. When a centre or residence contracts Kokaru Senior, the centre acts as controller towards the resident and we act as processor: its staff see the status of the residents they care for, and the family members authorised by the centre or the account holder.
We process your health data on the basis of your explicit consent (Art. 9(2)(a) GDPR and equivalent laws), which you can withdraw at any time. Other data is processed for the performance of the contract (providing the service), compliance with legal obligations (tax and accounting) and our legitimate interest in security and fraud prevention. Withdrawing consent does not affect the lawfulness of prior processing.
We keep your data while your account is active. When you delete your account or request deletion, we delete your data within 30 days at most, with these exceptions:

Depending on your country, you have the right to access, rectify, erase, restrict or object to processing, to data portability and to withdraw your consent. Write to privacidad@kokaru.com; we reply within 30 days. We apply, as relevant: Japan (Act on the Protection of Personal Information, APPI), Chile (Law No. 19,628 and Law No. 21,719) and the European Union / EEA (GDPR). If you are not satisfied, you can complain to the data protection authority in your country.
All traffic between the app and our servers is encrypted with TLS, and your data is stored encrypted at rest. Database access is restricted by per-user policies (row-level security), so each account only reaches its own data, and staff access is limited to what is strictly necessary and subject to confidentiality. No system is infallible: if a breach affecting your data occurs, we will notify you and the competent authority within the legal deadlines.
The Kokaru (Wellness) app is not intended for children under 16. Kokaru Kids does process children’s data, always under the responsibility and with the consent of their mother, father or legal guardian, who creates the account, decides who sees the information and can request its deletion. Children’s data is used only to show their account holders their sleep, activity, zone location and wellness moments; never for advertising or commercial profiles. Kokaru describes what it measures and does not diagnose. If you believe we hold a child’s data without authorisation, write to privacidad@kokaru.com.
We operate from Japan and provide the service in Chile, Colombia, Japan and Europe. Some of our processors (Supabase, Stripe, Mercado Pago, Resend, Anthropic, OpenAI, Cloudflare, Railway) process data in the United States and other countries. In those cases we apply the safeguards required by law — the European Commission’s standard contractual clauses or another valid mechanism — and contractually limit the use of the data to providing services to us.
kokaru.com does not use tracking, analytics or advertising cookies and installs no third-party trackers. It only uses one functional cookie (kk_site) that remembers the country you chose, to show you your country’s prices and payment methods. The web apps only use the local storage needed to keep you signed in.
You can exercise your rights of access, rectification, erasure, objection, portability and blocking at kokaru.com/proteccion-de-datos or by writing to privacidad@kokaru.com. We reply within 30 calendar days, extendable once by a further 30 days. If you are not satisfied, you can complain to the authority in your country: in Japan, the Personal Information Protection Commission; in Chile, the Personal Data Protection Agency.
We may update it. When a change is substantial we will tell you in the app or by email before it takes effect and, where the law requires it, ask for your consent again. The effective date always appears at the top.

これらの権限はすべて任意で、機能を使う時点で求めます。端末の設定からいつでも取り消すことができ、残りの機能でアプリは引き続き使えます。
Kokaru が Health Connect および Apple ヘルスケアのデータを読み書きするのは、あなたが端末で許可した場合のみであり、アプリ内でウェルネスの指標と傾向を表示する目的に限ります。
歩数、アクティブカロリー、上った階数、睡眠、体重、体脂肪、除脂肪体重。
Kokaru バンドの測定値（心拍数、心拍変動（HRV）、睡眠セッション）。ほかの健康データと並べて確認できるようにするためです。
あなたに法的効果を及ぼす自動化された意思決定は行いません。Kokaru のスコアは参考情報であり、医学的な診断ではありません。
当社はあなたのデータを販売・譲渡しません。データ処理契約と守秘義務契約を結んだ以下の委託先とのみ共有します。

このほか、あなたが発行する期限付きリンクを通じてあなたが選んだ医療専門職と、また法的義務がある場合は官庁と共有します。合併・買収などでサービスを他社に移転する場合は、事前にお知らせし、本ポリシーは引き続き適用されます。
食品と医薬品の検索は当社のインフラ上のカタログで処理し、第三者には送信しません。
勤務先を通じて Kokaru を利用する場合、勤務先はサービスを契約しますが、あなた個人のデータにはアクセスしません。法人向けポータルに表示されるのは k-匿名性を満たす匿名の集計のみで、個人を特定できるほど小さなグループは表示しません。勤務先があなたの指標・医療記録・個人スコアを受け取ることはなく、いかなる人事上の判断にも使われません。
決定権者：Kokaru Kids と Kokaru Senior では、アカウント所有者（母親・父親・法定後見人または責任を持つ家族）が、どの家族が情報を見られるかを決め、いつでもアクセスを取り消せます。Kokaru Kids の所有者は子ども1人につき最大2名で、オープンネットワークを有効にする前に保護者であることを確認します。
位置情報：位置はバンドを検知した Kokaru ゲートウェイから得ます。ゲートウェイを設置した場所（学校、施設、ほかの家庭）が子どもやそのデータを見ることはありません。暗号化された情報を中継するだけです。所有者は誰でも位置情報を一時停止でき、所有者が2名いる場合は再開に両名の同意が必要です。変更はすべて編集できない記録に残ります。
家庭用ゲートウェイ：自宅にゲートウェイを設置した場合、その位置を Kokaru Kids ネットワークと共有するかどうかを選べます。共有した場合、自宅のそばを通った子どもの家族に見えるのは地図上の地点のみで、あなたの氏名やデータが見えることはありません。いつでも無効にできます。
施設での Kokaru Senior：施設や高齢者住宅が Kokaru Senior を契約する場合、入居者に対しては施設が管理者、当社が委託先（処理者）となります。施設の職員は担当する入居者の状態を、施設または所有者が許可した家族はその情報を見ることができます。
健康データは、あなたの明示的な同意（GDPR 第9条2項(a) および同等の法令）に基づいて取り扱い、同意はいつでも撤回できます。その他のデータは、契約の履行（サービスの提供）、法的義務の遵守（税務・会計）、およびセキュリティと不正防止に関する当社の正当な利益に基づいて取り扱います。同意を撤回しても、それ以前の取扱いの適法性には影響しません。
データはアカウントが有効な間保持します。アカウントの削除または削除依頼を受けてから最長30日以内に削除します。ただし、以下を除きます。

お住まいの国に応じて、取扱いに対する開示・訂正・削除・制限・異議、データポータビリティ、同意の撤回の権利があります。privacidad@kokaru.com にご連絡いただければ、30日以内に回答します。適用する法令：日本（個人情報の保護に関する法律）、チリ（法律第19.628号および第21.719号）、EU／EEA（GDPR）。ご納得いただけない場合は、お住まいの国のデータ保護当局（日本では個人情報保護委員会）に申し立てることができます。
アプリと当社サーバー間の通信はすべて TLS で暗号化され、データは保存時も暗号化されます。データベースへのアクセスはユーザー単位のポリシー（行レベルセキュリティ）で制限され、各アカウントは自分のデータにしかアクセスできません。職員のアクセスも厳に必要な範囲に限られ、守秘義務を負います。完全なシステムは存在しないため、あなたのデータに影響する漏えいが発生した場合は、法定期限内にあなたと所轄官庁に通知します。
Kokaru（Wellness）アプリは 16歳未満の方を対象としていません。Kokaru Kids は子どものデータを取り扱いますが、常に母親・父親または法定後見人の責任と同意のもとで行います。保護者がアカウントを作成し、誰が情報を見るかを決め、削除を依頼できます。子どものデータは、所有者に睡眠・活動・ゾーン単位の位置・ウェルネスの瞬間を示すためにのみ使い、広告や商業的プロファイルには決して使いません。Kokaru は測定した内容を示すもので、診断は行いません。許可なく未成年者のデータを保有していると思われる場合は、privacidad@kokaru.com にご連絡ください。
当社は日本から運営し、チリ・コロンビア・日本・欧州でサービスを提供しています。一部の委託先（Supabase、Stripe、Mercado Pago、Resend、Anthropic、OpenAI、Cloudflare、Railway）は米国その他の国でデータを処理します。その場合は、法令が求める保護措置（欧州委員会の標準契約条項またはその他の有効な仕組み）を講じ、データの利用を当社へのサービス提供に限るよう契約で定めています。
kokaru.com はトラッキング・分析・広告用のクッキーを使用せず、第三者のトラッカーも設置しません。使用するのは、選んだ国を記憶して、その国の価格と支払い方法を表示するための機能クッキー（kk_site）1つだけです。Web アプリはログイン状態の維持に必要なローカルストレージのみを使います。
開示・訂正・削除・異議・ポータビリティ・利用停止の権利は、kokaru.com/proteccion-de-datos または privacidad@kokaru.com から行使できます。30暦日以内に回答し、1回に限りさらに30日延長することがあります。ご納得いただけない場合は、お住まいの国の当局（日本では個人情報保護委員会、チリでは個人データ保護庁）に申し立てることができます。
本ポリシーは更新されることがあります。重要な変更の場合は、施行前にアプリ内またはメールでお知らせし、法令が求める場合は改めて同意をお願いします。施行日は常に冒頭に記載します。
